Welcome to Fresh Bait Co. By accessing or using freshbaitco.com (the "Site") or purchasing our products, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site.
1. Eligibility
By using the Site, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms.
2. Products and Orders
Fresh Bait Co. sells fishing lures and accessories, including our Nexus System with interchangeable lure skins. We reserve the right to limit quantities, discontinue products, or refuse and refund orders at our discretion. Product images are for illustrative purposes and actual products may vary slightly.
By placing an order, you represent that the information you provide is accurate and complete. We reserve the right to cancel orders that appear fraudulent or that contain errors.
3. Pricing and Payment
All prices are in U.S. dollars. We reserve the right to change prices at any time without notice. Payment is required at the time of purchase. Sales tax will be applied where required by law.
4. Shipping
We ship to addresses within the United States. Estimated shipping times are provided at checkout and are not guaranteed. Fresh Bait Co. is not responsible for delays caused by shipping carriers or other factors outside our control. Risk of loss passes to you upon delivery to the carrier.

6. Intellectual Property
All content on the Site — including text, images, logos, product designs, and the Fresh Bait Co. Nexus System concept — is the property of Fresh Bait Co. and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission. All lure design, including the models and the nexus sytem are intellectual property of Fresh Bait Co. and/or "inventor".
7. User Conduct
You agree not to use the Site for any unlawful purpose, attempt to gain unauthorized access to any portion of the Site, transmit harmful or offensive content, or use automated tools to scrape data from the Site.
8. Disclaimer of Warranties
THE SITE AND PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, FRESH BAIT CO. DISCLAIMS ALL WARRANTIES, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FRESH BAIT CO. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE AT ISSUE.
10. Indemnification
You agree to indemnify and hold harmless Fresh Bait Co. and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Site or violation of these Terms.
11. Governing Law
These Terms are governed by the laws of the State of California. Any disputes shall be resolved exclusively in the state or federal courts located in California at the discretion of Fresh Bait Co., not to be decided by any other party.

We reserve the right to update these Terms at any time. Changes will be effective upon posting to the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. Your use of the Site is accepting that these may change, and it is your responsibility to review them for changes. Fresh Bait Co. is not responsible to notify of any changes.
